PITTSBURGH- A judge in Central Pennsylvania's Central Florida home, where she has been since she was a teenager, has ordered the removal of nearly 700 bottles of Viagra and other erectile dysfunction drugs from the home. In a statement, the judge said that while some drugs will not be removed, other drugs, such as Cialis, have been removed.
The court did not know whether a pharmacist, who has received Viagra's manufacturer's warnings, was able to determine that the drug was safe. However, the court's order requires her to remove the drugs at a later time and in the future.
"PITTSBURGH'S HEALTHCARE, INC. is committed to ensuring that patients who are purchasing drugs from unregistered and illegal outlets are treated with appropriate medical care in a safe and effective manner," the judge wrote.
PITTSBURGH'S HEALTHCARE, INC. will pay $2.1 million, to settle a federal civil lawsuit filed against the pharmacy chain in Central Florida. The suit was brought under the False Claims Act.
"Our firm believes this is an appropriate case in which we will vigorously defend our pharmacy," said Michael C. O'Brien, executive vice president of pharmacy and compliance at U. S. Immigration and Customs Enforcement's (ICE) Homeland Security and Governmental Affairs Division.
The suit also alleges that the Food and Drug Administration (FDA) and other health care organizations, the U. government and the drug companies, had improperly marketed and promoted the prescription drugs in the United States. The suit alleges that the FDA and other health care organizations knew of the unsafe, illegal drug's potential risks and failed to properly disclose the product's contraindications to consumers.
The case was initially filed against O'Brien's company, U. Pharmacy Services, Inc., in the U. District Court for the Western District of Pennsylvania.

In 2007, U. Customs and Border Protection agents seized more than 1.25 million pills containing Viagra, Cialis and similar drugs valued at over $3 billion.
In addition to Viagra, the FDA is the only regulatory agency in the United States that regulates drugs. Under the Food and Drug Administration (FDA) Regulations, a prescription drug is defined as "any medicine used to treat the symptoms of a disease or condition."
This regulation was added in September 2008 to the U. Food and Drug Administration (FDA) Drug Enforcement Administration's (DEA) List of Nonprescription Drug Adverse Effects. Under the list, "all approved drugs contain the active ingredient sildenafil citrate," and "approved drugs that contain the same ingredient" are grouped together under the Drug Identification Card (DIC).
In 2007, the FDA issued an alert on sildenafil citrate. This warning was based on the FDA's determination that the drug was unsafe and not being used by U. citizens.
The FDA has continued to use sildenafil citrate as a safety measure, as well as some other "off-label" applications.
The U. Food and Drug Administration has received a number of sildenafil citrate applications from companies that have not yet been approved for sale or distribution. These companies, including Pfizer, have received reports that the drugs may have potentially dangerous or life-threatening effects, including heart-related deaths and seizures. FDA officials are warning consumers that while sildenafil citrate is not approved for use in children, its safety has been established for adults.
The FDA has also been notified of a new warning on sildenafil citrate, which is not approved for use in children. The warning applies to products that contain sildenafil citrate only in pediatric patients.
In the past, the FDA has not been advised of a new warning. In June 2010, the FDA sent a letter to manufacturers of the erectile dysfunction drug, Pfizer's Viagra, in response to concerns over the safety and potential risks of the drug. The letter, which was signed by Dr. Wayne Hellstrom, is available on the FDA's website.
Food and Drug Administration (FDA) has not received any reports of serious adverse events related to sildenafil citrate.
